LEASING CONTRACT
Rental Agreement, Waiver and Release Effective Date: July, 2025.
PLEASE READ THIS AGREEMENT CAREFULLY. THIS ESTABLISHES THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOU TO USE THE GO-ON SERVICE. IF YOU DO NOT AGREE WITH ANY OF THE TERMS, PLEASE DO NOT USE THE GO-ON SERVICES AND TECHNOLOGY.
BY USING OUR SERVICE THE USER ACCEPTS, CONFIRMS AND RATIFIES. THAT HE IS SOLELY RESPONSIBLE FOR THE USE OF THE SCOOTER AND HE IS RESPONSIBLE FOR PERSONAL INJURY, HIS OWN OR THIRD PARTIES THAT MAY BE CAUSED, RELEASING THE COMPANY FROM ANY RESPONSIBILITY. YOU CONFIRM BY DECLARATION AND SIGNING THIS CONTRACT THAT YOU ARE OF AGE, WITH A LICENSE TO DRIVE AND CERTIFY THAT YOU ARE KNOWN THAT YOU MUST USE PERSONAL PROTECTIVE EQUIPMENT TO SAFEGUARD YOUR PHYSICAL INTEGRITY AND THAT OF OTHERS. THIS SERVICE IS NOT FOR MINORS.
BY ACCEPTING THIS AGREEMENT OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF ITS TERMS. IMPORTANT NOTICE: THIS AGREEMENT CONTAINS AN ARBITRATION PROVISION AND A WAIVER OF CLASS ACTION RIGHTS OR CLASS ACTIONS REPRESENTED BY ONE PERSON, AS SET FORTH IN SECTION 9 BELOW. BY AGREEING TO ARBITRATION, YOU GIVE UP YOUR RIGHT TO HAVE A JUDGE OR JURY HEAR ANY DISPUTE IN COURT. BY AGREEING TO WAIVE CLASS ACTION RIGHTS OR CLASS ACTIONS REPRESENTED BY ANYONE, YOU AGREE TO BRING A CLAIM AGAINST GO-ON ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. KNOWING THAT THE RESPONSIBILITY FOR ANY ACCIDENT IS SOLELY OF THE PERSON WHO USES, ACCEPTS AND IS THE OWNER OF THE GO-ON ACCOUNT. Each unlocking and use of the application for a GO-ON scooter is certification and acceptance of the above and following points expressed in this contract.
GO-ON app collects location data to enable the rental process to keep track of the route of the rental even when the app is closed or not in use.
In consideration of Your use of any of the GO ON Services (defined below) provided by Servicios de Movilidad y Logística, S.A. (“GO ON”), GO ON requires that You (“Driver”, “You” or “Your”) (acting on behalf of the Driver’s entire family, heirs, agents, affiliates, representatives, successors and assigns) agree to all the terms and conditions contained in this GO ON Lease, Waiver and Release of Liability Agreement (“Agreement”).
The services provided by GO ON include (1) the GO ON mobile application and related website, (2) GO ON Electric Vehicles (“Vehicle” or “Vehicles”), (3) discretionary charging of the Vehicle by the Driver in accordance with Section 1.15 below, and (4) all other equipment, personnel, services, applications, web pages and related information provided or made available by GO ON (collectively the “GO ON Services”).
The GO ON mobile application and related website are the property of GO ON or an affiliate and your general use thereof will be governed by the Terms of Service, which are located in the application, which You expressly agreed to at the time of purchase. register GO ON, and full acceptance of this contract is ratified in each trip you make on a GO ON scooter. The use of the mobile application and the website in connection with the use of the Vehicles will be governed by this Agreement.
You must CAREFULLY READ all the terms and conditions before entering into this Agreement, but here we present a partial list of some of the terms that GO ON would like you to take into account initially in the event that you are using a smartphone (smartphone) or other device with a small screen. Terms that begin with a capital letter have the meanings attributed to them when defined in this Agreement.
This Agreement sets forth the terms and conditions governing your use of GO ON electric scooters (the “Scooter(s)”), the related proprietary mobile application (the “Application”) and all other equipment, software, services and information. that GO ON provided or made available to you pursuant to this Agreement (collectively, the “Services”). You should carefully read this Agreement in its entirety before accepting it or using the Services, but below is a list of certain terms that GO ON would like to bring to your initial attention. • You must be at least 18 years of age or authorized and represented by an adult responsible for activating the Scooter, weigh 220 pounds or less, and be in adequate physical condition to operate a Scooter. • You may not allow anyone else to use a Scooter that you have activated, nor may you carry an additional person or child on a Scooter. • It is your responsibility to perform a safety inspection of a Scooter before beginning operation. • You must lock the Scooter at the end of your trip and verify that the unit has been effectively locked. If you do not do so, you will continue to be charged the fee specified on www.igogoon.com. The maximum charge for a single ride is $300 per 24 hours. And if the unlocked unit is vandalized, stolen or misused, the user will be charged from $400 to $1,000 depending on the case. For additional information regarding rental charges, see Section 2.4 below. There is no refund of money for top-ups made to the WALLET under any circumstances. 2.4 below. • At the end of your trip, you must park the Scooter in an accessible area. Do not leave a Scooter in a restricted area, such as on private property, in a gated area or in any other non-public or inaccessible space, doing so may result in charges ranging from $50 to $500 depending on the severity of the situation. THE RETURN AND SPACE WHERE you rent the GO-ON scooter, you agree to LEAVE THE SCOOTERS IN PUBLIC SPACES WITHOUT INTERRUPTING THE PATH OF PEDESTRIANS, SPECIAL RAMPS ENTRANCES TO BUILDINGS AND DEPENDING ON THE TERRITORY, LEAVE THEM IN THE DESIGNATED MANDATORY SPACES WHICH ARE DECIDED HEREIN OF THE APPLICATION IN THE AREA OF RETURN LOCATIONS, IF YOU DO NOT COMPLY WITH THESE POINTS YOU AGREE THAT YOU MAY BE FINED ACCORDING TO THE RATES EXPRESSED IN THIS CONTRACT. • You must obey all local laws when operating a Scooter, including, but not limited to, traffic laws, helmet laws, rules and regulations regarding moving vehicles and/or parking, and those intended to protect the public. pedestrians. •You must immediately report a damaged, defective or stolen Scooter to GO ON via the app or by email info@igogoon.com. 1. Rental and use. 1.1 Exclusive responsibility. You and GO ON are the only parties to this Agreement. You are the sole lessee of the Scooter and are solely responsible for compliance with the terms of this Agreement. When you activate a Scooter, you are the only one who can use it. You may not allow anyone else to use a Scooter that you have activated. 1.2 Safe operation. You represent and certify that you are at least 18 years of age or that you are authorized and represented by an adult responsible for the activation of the Scooter, that you do not weigh more than 220 pounds and are in adequate physical condition to operate a Scooter without risk to you or others. You acknowledge and agree that you are responsible for determining whether prevailing weather, visibility, traffic or environmental conditions make it dangerous to operate a Scooter. If at any time you believe that conditions are unsafe or that you are no longer in suitable physical condition to operate a Scooter, you will immediately discontinue such operation. 1.3 Personal security. You acknowledge that GO ON recommends that you wear a Snell, CPSC, ANSI, or ASTM approved helmet that has been properly sized, fitted, and fastened in accordance with the manufacturer's instructions at all times while operating a Scooter. You acknowledge that you may need to take additional security measures and precautions that are not specifically addressed in this Agreement. You acknowledge and agree that your failure to wear a helmet or take additional safety precautions is at your own will and risk. You acknowledge and agree that GO ON is not responsible for any injury sustained by You while using the Services AND operating a Scooter, whether or not You are wearing a helmet at the time of injury. 1.4 Scooter safety inspection. You agree to perform a basic safety inspection before using a Scooter, check for signs of damage,
unusual or excessive wear or other mechanical problems or maintenance problems. You agree not to operate a Scooter if there are notable problems and to immediately notify GO ON at info@igogoon.com of such problems. 1.5 Area of use. You acknowledge that: (a) GO ON does not provide or maintain places to ride Scooters; (b) GO ON does not guarantee that there will always be a safe place to ride a Scooter; and (c) roads, sidewalks, lanes, and routes may become hazardous due to weather, traffic, or other hazards. You agree to use and operate Scooters only in metropolitan areas where it is permitted to do so. You agree that you will not operate or use a Scooter on the avenues, streets, or highways where motor vehicles circulate, including on unpaved roads, through water (beyond normal urban driving) or in any place that is prohibited, illegal. and/or disturb others. 1.6 Problems inherent to electric scooters. You acknowledge that the Scooter is an electric vehicle and that the level of charging power at the time you initiate operation, and the distance and/or time that the Scooter can be operated before charging power decreases or is lost, It is not guaranteed and will vary with each rental. You agree that it is your responsibility to verify the charging power level before beginning operation and understand that the Scooter may run out of power and stop operating at any time during your rental, including before reaching your desired destination. 1.7 Compliance with laws. You agree to follow all applicable laws relating to the use, riding, parking, and operation of a Scooter, including, but not limited to, traffic laws, helmet laws, rules and regulations relating to the movement of vehicles and / or parking lots, and those intended to protect pedestrians. 1.8 No alterations. You agree that you will not tamper with, attempt to gain unauthorized access to, or otherwise use any GO ON system or equipment for the purposes of renting and using a Scooter in accordance with this Agreement. 1.9 Condition of the scooter upon return. You agree to return the Scooter to GO ON in the same condition in which you rented it. Will not be responsible for normal wear and tear. 1.10 Limitation of the availability of services. GO ON does not represent or guarantee the availability of the Services or a Scooter at any time. You agree and acknowledge that the Scooters are not available 24 hours a day, 7 days a week, 365 days a year. You acknowledge that the number of Scooters is limited, and that the availability of Scooters is never guaranteed. You agree that GO ON may require you to return a Scooter at any time. 1.11 Reports of certain events. You agree to immediately report any accident or collision involving, or damage to, loss or theft of, a Scooter to GO ON at info@igogoon.com. Additionally, you agree to file a report with your local police department within 24 hours of any incident that results in personal injury or property damage. 1.12 Damaged scooters. You accept full responsibility for the Scooter and agree to pay for any damage to the Scooter at full retail value if it is damaged to the extent that repairs are not practical or feasible. 1.13 Lost or stolen scooter. A Scooter may be considered lost or stolen if (a) it is not returned within 24 hours of the start of the rental; (b) your GPS unit is disabled; (c) is parked in a restricted area, on private property, in an enclosed area, or in any other non-public space for more than 10 minutes after a trip ends; (d) moves more than 5 meters after a rental has ended and GO ON believes that such movement was not caused by another member of the maintenance team or authorized party; or (e) other facts and circumstances suggest to GO ON in its reasonable good faith determination that it has been lost or stolen. You agree that, if you are the last rider of the Scooter, you will be responsible for a lost or stolen Scooter unless the facts and circumstances suggest otherwise to GO ON in its reasonably good faith determination. If GO ON believes that a Scooter is lost or stolen, GO ON will have the authority to take all actions it deems appropriate, including, without limitation, obtaining restitution and other appropriate compensation and damages and filing a police report with local authorities. The data generated by the Service system is conclusive evidence of the period of use of a Scooter by a Rider. You must report a missing or stolen Scooter as soon as you become aware of it. You acknowledge and agree that you are responsible for any consequences, claims, demands, causes of action, losses, liabilities, damages, injuries, costs and expenses, fines, attorneys' fees, judgments, demands or disbursements of any kind or nature. everything related to a stolen or lost Scooter. You accept that if, due to not locking the unit at the end of your trip, it is stolen, GO ON may charge you the commercial value of the unit(s), and without any claim you will pay it. 1.14 Prohibited acts. You agree that: • You will not carry any briefcase, backpack, purse or other item that may impede your ability to safely operate the Scooter. • You will not use a smartphone or other device that may distract you from the safe operation of the Scooter. • You will not operate a Scooter while under the influence of alcohol, any illegal drug, or any toxic substance, narcotic, prescription medication, or other drug that may impair your ability to safely operate the Scooter. • You will not carry an additional person or child on a Scooter. • You will not use the Scooter for rental, or for racing, off-roading, stunts or tricks. • You will not use any locking mechanism not provided by GO ON. You will not add another lock to a Scooter or lock a Scooter to a tree, fence or any other item. • You will not park a Scooter in any restricted area, such as on private property, in a gated area, or in any other non-public or inaccessible space. • You will not disassemble, modify, repair or damage a Scooter, any part of a Scooter or any other GO ON equipment in any way, or mark, remove or otherwise alter any sticker on a Scooter. • You will not ride or park a Scooter on any road, driveway or surface that may cause damage to the Scooter. 1.15 GO ON owns the scooters. You acknowledge and agree that GO ON will at all times retain exclusive ownership and title to the Scooter and any equipment attached thereto. 2. Payment and fees. 2.1 Rates. You may use the Scooter on a pay-per-ride basis or otherwise in accordance with the prices described in the Application. Rates and other charges may be subject to applicable taxes and other local government charges, which are not included in the rate unless detailed within the application, which GO ON may charge in whole or in portions. and portions, even charging to the wallet automatically as well as requesting that a specific amount of money be recharged in your application wallet when you start using it to guarantee covering your rent, and this is something discretionary and is up to the criteria of the payment gateway system to do so. When you create an account using the app, GO ON will create an electronic wallet ("Wallet") for you to hold the credits you purchase to ride Scooters. You must provide valid and complete credit or debit card information before you register to use the Services and create a WALLET, and you agree to keep such information up to date for continued use of the Services. You represent and warrant that (a) the credit or debit card information you provide is true, correct and complete, (b) you are duly authorized to use such card for the purchase of the Services, (c) the charges incurred by You will be paid by the card company and (d) You will pay the charges incurred by You at GO ON's current prices, regardless of the amount indicated in the application at the time the charges are incurred. If you dispute any charge, you must contact GO ON within 5 business days of the end of the month in which the disputed charge was made and provide GO ON with all information necessary to identify and investigate the disputed charge. GO ON requires each user to have an initial security deposit of at least 50 credits (US$50.00) in their wallet, after which they can choose to deposit any amount, they want in their wallet as a "top-up" (i.e. adding additional credits) that will go toward the cost of your trips. If you exceed the number of credits in your wallet, you will have a negative balance and will not be able to start another trip until you add additional credits to your wallet so that there is a positive balance. If your wallet has a negative balance for three (3) consecutive days, GO ON will process the payment based on the payment method registered in your account to bring your wallet to a zero balance. If you do not intend to replenish your wallet again (for example, because you were using a scooter in a vacation city and do not intend to return), you agree that you cannot request a refund of the remaining credits deposited in your wallet, as Because it is a prepaid system, we do not offer any type of refunds or balance transfer to other users. 2.3 Promotional codes and memberships. Promotional codes, if any, can only be redeemed through the app. Promotional codes are limited to one per customer per account, and cannot be combined with other offers, transferred or resold. GO ON reserves the right to modify or refuse to apply a promotional code at any time, our memberships, which can be purchased in the membership area in the application, are a contract between you and GO-ON, you agree to have read the conditions of use and cost thereof. The maximum scooter rental time is 24 hours. Although you can reactivate it immediately, you agree to deactivate the rental within 24 hours of the start of the rental. You agree that you are solely responsible for keeping track of the time that has passed since the start of a Scooter rental. The maximum daily charge of $300 is based on one calendar day. In the event of late return of a Scooter, you will be charged the greater of the accrued rental charges, or the maximum daily charge. Scooters not returned (locked and disabled) within 24 hours may be considered lost or stolen and GO ON may file a police report and/or charge you up to $750. GO ON may also charge you a $250 service fee for rentals that exceed 24 hours in which the Scooter is not lost or stolen. INAPPROPRIATE USE OF SCOOTERS, such as jumping, maneuvers that may put the condition of the equipment at risk, may result in the user being blocked, as well as a penalty of up to $1,000. 2.5 Collection Fees. If you are unable to return a Scooter to a valid area (i.e., you disable the Scooter in a restricted area) and request that GO ON pick it up, GO ON may, in its sole discretion, charge you a fee of up to $150. If any Scooter accessed under your account is abandoned without notice, you will be responsible for all Trip Fees until the Scooter is recovered and deactivated, plus a service charge (currently $150) to recover the Scooter. All rates are subject to change at GO ON's sole discretion. PENALTIES: Penalties may vary depending on the act that is penalized. In the case of parking in prohibited areas, the penalty starts at $50 and can reach up to $150 depending on the case. Restricted areas may change without prior notice, so the user must be pending any changes to this restriction. 3. Releases; Disclaimers; Limitation of liability; Assumption of risk; Compensation. 3.1 Releases. You (acting for yourself and your entire family, heirs, agents, affiliates, representatives, successors and assigns) (each, a "Releasing Party" and collectively, the "Releasing Parties") completely and forever release and discharge GO ON and its affiliates, and each of their directors, officers, owners, shareholders, managers, employees, agents, representatives, insurers, successors and assigns (each, a “Released Party” and collectively, the “Released Parties”) from any and all injuries (including, without limitation, death), losses, damages, claims (including, without limitation, claims for negligence), suits, demands, expenses and any other liability of any kind (collectively, " Claims"), of you or your property or any other person, arising directly or indirectly out of or in connection with your use of any of the Services, including, without limitation, the rental, use, operation or misuse operation of a Scooter, even if due to the negligence, wrongful act, omission or other fault of a Released Party. Such releases are intended to be general and complete releases of all Claims. Released Parties may assert such waivers as a complete and sufficient defense to any.
Claim, as intended third-party beneficiaries of said exemptions. You understand and agree that, except where expressly prohibited by law, you elect and assume all risks of Claims, known or unknown, suspected, or unsuspected, arising from this Agreement, and you specifically waive any rights you may have under any statute or principle. common law in any jurisdiction. NEITHER GO ON NOR ANY OF THE OTHER RELEASED PARTIES REPRESENTS OR WARRANTS THAT ANY SCOOTER OR RELATED EQUIPMENT WILL BE IN GOOD REPAIR, ERROR-FREE OR OPERABLE. NEITHER GO ON NOR ANY OTHER RELEASED PARTY MAKES ANY WARRANTY, EXPRESS OR IMPLIED, OR BY COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE, WITH RESPECT TO THE SERVICES, AND ALL REPRESENTATIONS AND WARRANTIES OF MERCHANTABILITY AND FACILITY PURPOSE IS EXPRESSLY DISCLAIMED. 3.3 Limitation of liability. YOU ACKNOWLEDGE AND AGREE THAT, EXCEPT AS LIMITED BY LAW, NEITHER GO ON NOR THE OTHER RELEASED PARTIES ARE RESPONSIBLE OR LIABLE FOR ANY CLAIM, INCLUDING THOSE ARISING OUT OF OR IN CONNECTION WITH (A) ANY RISK, DANGER OR DANGER DESCRIBED IN THIS AGREEMENT , (B) YOUR USE OR INABILITY TO USE ANY OF THE SERVICES, SCOOTERS OR RELATED EQUIPMENT, (C) YOUR BREACH OF THIS AGREEMENT OR VIOLATION OF ANY LAW, (D) YOUR NEGLIGENCE, MISCONDUCT OR OTHER ACTION OR INACTION, (E ) YOUR FAILURE TO WEAR A HELMET WHILE USING A SCOOTER, OR (F) THE NEGLIGENCE, MISCONDUCT OF ANY THIRD PARTY, OR OTHER ACTION OR INACTION. YOU HEREBY WAIVE ALL CLAIMS WITH RESPECT TO ANY OF THE FOREGOING, INCLUDING THOSE BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE. THE CUMULATIVE LIABILITY OF GO ON AND THE OTHER RELEASED PARTIES FOR ALL CLAIMS, INCLUDING THOSE BASED ON CONTRACT, ABSOLUTE AND TOTAL (INCLUDING NEGLIGENCE), STATUTE OR OTHERWISE, IS LIMITED TO THE SUM OF $1000.00. SOME JURISDICTIONS DO NOT ALLOW LIMITED LIABILITY OR EXCLUSION OF IMPLIED WARRANTIES, AND, IF ANY OF THE LAWS APPLY TO YOU, THEN SOME OR ALL OF THE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS. 3.4 Assumption of risk. You are solely and fully responsible for the safe operation of the Scooter. You acknowledge that Scooters are machines that may malfunction, even if properly maintained, and that such malfunction may cause injury. You understand that operating a Scooter involves inherent risks and dangers of accidents, emergency treatment, property loss or damage, serious personal and bodily injury, death, and serious personal and economic loss. These may result not only from your own actions, inactions or negligence, but also from the actions, inactions or negligence of others, the condition of the Scooter itself, or weather or road conditions, among other causes. In addition, there may be other risks unknown to You or reasonably foreseeable. You understand and have considered the risks involved, and you voluntarily and freely choose to assume those risks. By choosing to ride a Scooter, you assume full and complete responsibility for all related risks, hazards and dangers, and agree that neither GO ON nor any other Released Party is
responsible for any injury, damage or cost caused by you to any person or property, including Scooter itself. You understand that neither GO ON nor the other Released Parties provide You with any insurance (including, without limitation, life, medical or liability insurance) for any illness, accident, injury, loss, or damage that may arise in connection with Your use or the Services and/or operation of a Scooter. You agree that you will pay your own emergency medical expenses and all subsequent medical expenses associated with any illness, accident or injury arising from or related to your use of the Scooter. 3.5 Compensation. YOU EXPRESSLY AGREE, DEFEND, HOLD AND HOLD HARMLESS GO ON AND THE OTHER PARTIES FROM AND AGAINST ANY AND ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING, BUT NOT LIMITED TO, REASONABLE FEES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR OPERATION OF A SCOOTER, INCLUDING, BUT NOT LIMITED TO, YOUR FAILURE TO COMPLY WITH ANY PROVISION OF THIS AGREEMENT. You will use your best efforts to cooperate in the defense of any claim and acknowledge and agree that a Released Party may, at its own expense, employ separate counsel and assume the exclusive defense and control of any matter subject to indemnification under this Agreement. . 4. Term and termination. 4.1 Term The term of this Agreement begins when You first use the Service and ends 10 years after Your last use of the Services, provided that your personal financial responsibility under this Agreement expires one year after your last use of the Services. 4.2 Termination by GO ON or by you. At any time and without prior notice or consent, GO ON may unilaterally terminate your right to use the Services. You may terminate your use of the Services at any time; provided, however, that (a) GO ON will not provide any refund, (b) the term of this Agreement will continue as set forth in Section 4.1 above, and (c) You may be charged additional applicable fees in accordance with this agreement. This Agreement remains in full force and effect, in accordance with its terms and conditions, after termination of your right to use any of the Services, regardless of how the Agreement is terminated. 5. Confidentiality of information; Privacy Policy. Risks, damages, or contingencies include, but are not limited to:
vehicles and other objects.
∙ pedestrians.
∙ transit.
∙ failure of the Vehicle or a component.
∙ road conditions.
∙ climatic conditions.
∙ failure to comply with applicable legislation regarding the use and/or operation of the Vehicle in accordance with Section 1.7.
∙ commission of any of the prohibited actions listed in Section 1.8; ∙ failure to comply with security checks pursuant to Section 3.1; ∙ failure to wear a helmet when required by law; and negligent acts or omissions on the part of GO ON, any other Exempt person, the Driver or any third party.
∙ The Driver is always solely and completely responsible for the safe operation of the Vehicle. Driver agrees that Vehicles are machines that may malfunction even if the Vehicle is properly maintained and that such malfunction may cause injury.
∙ The Driver assumes full and complete responsibility for all risks, damages and related continence’s.
To the maximum extent permitted by law, this release and liability agreement includes any and all Claims related to or arising from the partial or sole negligence of GO ON, the Released Parties, any Municipality, Territorial Demarcation, State or any other party. The Driver hereby expressly waives any claim against the Exempt Parties, any Municipality, Territorial Demarcation, State or any other party that the Driver does not know or suspect exists in his favor at the time of use of the GO ON Services, and expressly waives the Driver's rights arising from any law that purports to preserve the Driver's unknown claims.
You acknowledge that (a) you have read this Agreement; (b) understand the terms and consequences of this Agreement, including the releases contained therein; and (c) are fully aware of the legal and binding effect of this Agreement.
